("Glowbom," "we," "us" or "our"). Accepting these Terms If you access or use the Service, it means you agree to be bound by all of the terms below. This Agreement is entered into between you and Glowbom, Inc. If you have been provided access to the Service through your relationship with a third-party company, you acknowledge that such company is not a party to this Agreement. For example, we may change these Terms if we come out with a new feature. Privacy Policy For information about how we collect, use and share information about you via the Service, please see our Privacy Policy: Privacy Policy Creating an Account with Glowbom When you create a member account, you agree to maintain the security of your password and accept all risk that someone may access your account without your permission. As a user you are also aware that a compromised password can lead to your sensitive and personal information being leaked. If you discover or suspect any Service security breaches, please let us know as soon as possible. You represent and warrant to us that all information that you provide in connection with your account is accurate, truthful, current and complete. Glowbom, Inc. reserves the right to deny, deactivate, or terminate any account at our discretion. When you create a member account, you agree to subscribe to our newsletter. Using Glowbom Who Can Use It. Use of Glowbom by anyone under 13 years of age is prohibited. You represent that you are at least the age of majority in the jurisdiction where you live or, if you are not, your parent or legal guardian must consent to these Terms of Service and affirm that they accept this Agreement on your behalf and bear responsibility for your use. If you are accepting these Terms of Service on behalf of someone else or an entity, you confirm that you have the legal authority to bind that person or entity to this Agreement. Storing Your App Data. By default, we store your app data locally only. The app data never goes to the Glowbom servers by default. Don't forget to export your project to avoid app data loss. You can always import your app data by pressing the "arrow up" button. Glowbom's Glowby and other functions on the platform are powered by advanced AI models, including GPT-3.5 Turbo, GPT-4, and GPT-4o from OpenAI, as well as Claude 3.5 Sonnet from Anthropic. These models offer broad general knowledge and domain expertise, can follow complex instructions in natural language, and solve difficult problems with accuracy. Please review OpenAI's terms of service and Anthropic's terms of service for more information. Glowbom's Glowby supports image generation powered by DALL·E. OpenAI’s DALL·E 2 system generates unique images and art from text descriptions, combining concepts and styles in creative and inspiring ways. Prohibitions You will not use the Glowbom Content or Glowbom Platform in connection with any Device or Application that is targeted to children under the age of thirteen (13). You may not decompile, reverse engineer, or otherwise attempt to discover the source code of the software. You do not have the right to sublicense the Service, download or modify any portion of the Service, or resell the Service. If you violate the Terms of Service, we reserve the right to terminate your license to the Service without notice. Refund Policy We value our customers' satisfaction and are committed to providing high-quality products and services. If you are not satisfied with your purchase, you may request a refund within a reasonable period of time. To be eligible for a refund, please contact our customer support team at support@glowbom.com with your order details and the reason for your refund request. Refunds will be processed, excluding the Stripe fees incurred, using the original payment method within a certain number of days, depending on your payment provider's policies. Please note that we reserve the right to refuse refund requests if we determine that they do not meet our refund policy requirements or if we suspect abuse of the refund policy.
